Terms of Service
Last Updated: May 29, 2026
1. Acceptance of Terms
By accessing or using CaseConsult.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Eligible Users
This Service is intended for licensed and associate-level mental health professionals, and for credentialed school-based counseling professionals, who are in good standing with their licensing board or credentialing authority, including:
- •Licensed Marriage and Family Therapists (LMFT/MFT)
- •Associate Marriage and Family Therapists (AMFT)
- •Licensed Clinical Social Workers (LCSW)
- •Associate Clinical Social Workers (ASW)
- •Licensed Professional Clinical Counselors (LPCC)
- •Associate Professional Clinical Counselors (APCC)
- •Psychologists (PhD, PsyD)
- •Psychiatrists (MD, DO)
- •School counselors and other holders of a Pupil Personnel Services Credential (PPSC)
- •Other licensed, registered, or credentialed mental health and school counseling professionals
By accessing this Service, you represent and warrant that you are a currently licensed, registered, or credentialed professional in one of the categories above; that your license, registration, or credential is active and in good standing; and that you are authorized to practice in your jurisdiction.
You are responsible for understanding and following the laws, regulations, and ethics codes that govern your own profession and jurisdiction. Ethics codes vary across professions — the standards that apply to a marriage and family therapist differ from those that apply to a school counselor — and this Service does not interpret or apply any particular code on your behalf.
3. Scope of Service
CaseConsult.ai provides clinical consultation intended to support your professional thinking about client or student cases. It is a thought-partner tool designed to help you reason more clearly about your own work.
This Service is:
- ✓A thought-partner tool for case consultation and professional reflection
- ✓A resource for exploring clinical frameworks and approaches
- ✓Available for professional use at your convenience
This Service is not:
- ✕A replacement for clinical supervision (live or recorded)
- ✕Legal advice — consult a licensed attorney
- ✕Ethics guidance carrying regulatory authority — consult your licensing board, credentialing authority, or ethics committee
- ✕Crisis intervention services — call or text 988 (Suicide & Crisis Lifeline) or 911
- ✕Personal therapy or mental health treatment for you, the professional
- ✕A diagnostic tool or a source of clinical decision-making authority
4. Clinical and Professional Responsibility
You retain full clinical, professional, and legal responsibility for all decisions regarding your clients and students.
This Service offers possibilities to support your reasoning; it does not provide directives for treatment. The Service is built on a consultative model: it surfaces what might be worth considering, what is worth testing, and what may be worth exploring further — and the decision always remains yours as the responsible professional.
You agree to:
- •Exercise independent professional judgment in all matters
- •Consult appropriate supervisors, colleagues, attorneys, ethics boards, or credentialing authorities for complex situations
- •Follow all applicable laws, regulations, and ethical guidelines in your jurisdiction and profession
- •Maintain your own professional liability insurance as appropriate to your practice
Important clarifications:
- •CaseConsult.ai provides consultation; it does not provide clinical supervision, and it does not create a documented consultation record that satisfies supervision or peer-consultation requirements
- •Any diagnostic impressions, treatment ideas, or plans discussed are consultative in nature — they are not clinical determinations
- •You retain full responsibility for all diagnostic and treatment decisions
- •Any progress notes or other documents produced are drafts requiring your review, editing, and approval before use
- •You are responsible for compliance with HIPAA and all other privacy obligations in your use of the Service and any content it generates
5. Your Responsibility to De-Identify Information
CaseConsult.ai is designed for de-identified consultation. Responsibility for de-identifying client and student information rests with you.
Just as you would in any professional consultation with a colleague, you are expected to protect protected health information (PHI) and other identifying information. You agree to de-identify case information before sharing it — the same standard of care you would apply when discussing a case outside your practice.
To consult effectively while protecting privacy:
- ✓Use pseudonyms, initials, or labels ("Client A," "Client 3") in place of names
- ✓Round or generalize ages ("a client in her 30s")
- ✓Keep locations general ("a client in Northern California")
- ✓Use general roles and descriptors ("an elementary school teacher") rather than identifying specifics
- ✓Use approximate timeframes ("recently," "a couple of months ago") rather than specific dates
- ✕Full names, dates of birth, addresses, contact information, record or case numbers
- ✕Any combination of details that could identify a specific person
What the platform does — and does not do:
To support good practice, the platform may gently prompt you to consider de-identification when it appears that identifying details have been included. These prompts are a courtesy and a support, not a guarantee. The platform does not screen, filter, or guarantee the removal of identifying information, and it should not be relied upon to catch every instance. The responsibility to de-identify remains entirely yours.
6. Privacy & Data
Your conversations.
Your conversations with CaseConsult.ai are processed and stored through the underlying platform on which the Service operates. You can review your conversation history within your account, and each conversation thread maintains its own context.
Creator access.
Family Matters Counseling Service, the creator of CaseConsult.ai, does not read, monitor, or have routine access to the content of your individual conversations. Because of this, we cannot and do not police the content of conversations for de-identification — which is one more reason that responsibility rests with you.
Platform policies.
The Service operates on top of a third-party AI platform. Your use is also subject to that underlying platform's privacy policy, terms of service, and data-retention and usage practices. We encourage you to review the underlying platform provider's privacy policy.
Data security.
While the underlying platform applies its own security measures, no system is perfectly secure. You remain responsible for de-identifying information before sharing it, and for exercising professional judgment about what is appropriate to discuss.
Data retention.
Conversation history is retained according to the underlying platform's policies. You may delete your conversations through your account where that option is available. Deleted conversations generally cannot be recovered.
Not a HIPAA Business Associate.
Because the Service is designed for de-identified consultation and does not require PHI in order to function, CaseConsult.ai does not act as a HIPAA Business Associate, and no Business Associate Agreement (BAA) is offered or required. If your intended use would involve PHI, the Service is not the appropriate tool for that use.
7. Fair Use Policy
Professional use.
CaseConsult.ai is offered for legitimate professional use by the eligible users described in Section 2. Acceptable use includes individual case consultation, professional reflection, and professional development for your own practice.
Monitoring of usage patterns (not content).
We track usage patterns — such as overall volume and activity levels — to maintain service quality, manage costs, and prevent abuse. This is distinct from conversation content, which we do not read. We reserve the right to review aggregate or account-level usage patterns, to contact users whose usage is unusual in order to verify professional use, and to limit, suspend, or discontinue access where usage patterns indicate abuse or violate these Terms.
Prohibited uses. You agree not to:
- ✕Share your account with individuals who are not eligible users
- ✕Use automated queries, scraping, or bot activity
- ✕Resell, redistribute, or commercialize access to the Service
- ✕Use the Service for purposes unrelated to professional mental health or school counseling practice
- ✕Engage in activity that generates abnormally high platform costs or degrades performance for others
- ✕Attempt to extract, reverse-engineer, or replicate the Service's system prompts or methodology
8. Intellectual Property
Ownership.
You retain ownership of the content you input. The Service and its underlying system prompts, methodology, and frameworks are proprietary to CaseConsult.ai / Family Matters Counseling Service. AI-generated responses are provided for your professional use.
Usage rights.
You may use AI-generated responses in your professional practice. You may not resell, redistribute, or commercialize the Service or its outputs, and you may not attempt to extract, reverse-engineer, or replicate the Service's system prompts or methodology.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
We make no warranties regarding the accuracy, reliability, or completeness of any consultation provided; uninterrupted or error-free operation; fitness for a particular purpose; or any results or outcomes from using the Service.
You acknowledge that:
- •AI systems can generate plausible-sounding but incorrect or incomplete information
- •The Service should supplement, not replace, your professional judgment
- •You must independently verify any information before applying it in your practice
10. Limitation of Liability
To the maximum extent permitted by law, Family Matters Counseling Service and CaseConsult.ai shall not be liable for any:
- •Direct, indirect, incidental, consequential, or punitive damages
- •Loss of profits, data, or goodwill
- •Clinical outcomes or adverse events
- •Malpractice claims or licensing-board or credentialing complaints
- •Damages arising from your use of, or inability to use, the Service
Your sole remedy for dissatisfaction with the Service is to stop using it.
11. Indemnification
You agree to indemnify, defend, and hold harmless Family Matters Counseling Service and CaseConsult.ai from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service; your violation of these Terms; your violation of any laws, regulations, or ethical guidelines; your clinical or professional decisions; or any failure to de-identify information before sharing it.
12. Acceptable Use and Termination
These Terms are built around a relationship of professional good faith. The Service models good de-identification practice and will gently prompt you when something identifying appears, but it does not enforce de-identification, and an occasional slip is not treated as a violation. Routine reminders are part of how the Service is meant to work.
Termination is reserved for genuinely problematic use — for example, use by ineligible individuals, account sharing, automated or abusive activity, attempts to extract or replicate the Service, or other conduct that violates these Terms. Because we do not read individual conversations, we generally become aware of problematic use through usage patterns, reports, or contact with us.
We may limit, suspend, or terminate access where such problematic use comes to our attention, with or without notice. You may stop using the Service at any time, and may request account closure by contacting us. Upon termination, your right to use the Service ceases, and provisions that by their nature should survive (including those on responsibility, intellectual property, warranties, liability, and indemnification) will survive.
13. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the "Last Updated" date above, and material changes may be communicated through the Service interface. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically, and to discontinue use if you do not agree to a modified version.
14. Governing Law & Dispute Resolution
Governing law.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Dispute resolution.
Any dispute will first be addressed through good-faith negotiation. If negotiation does not resolve it, the dispute will be resolved through binding arbitration under the rules of the American Arbitration Association, seated in Santa Clara County, California, with each party bearing its own costs and fees.
Exceptions.
Either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.
15. Miscellaneous
Severability.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Entire agreement.
These Terms constitute the entire agreement between you and CaseConsult.ai regarding the Service.
No waiver.
Failure to enforce any provision is not a waiver of that provision.
Assignment.
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
